"Off-the-clock" Work
Employers must pay for all work performed by their employees. Employers may not avoid paying employees for any work performed "off-the-clock." Such "off-the-clock" work may include tasks performed before or after assigned shifts which are integral and indispensable to the primary work activities such as "logging on" and "logging off" from computer systems, programs, and applications, reading company information, dressing in required clothing or protective gear, and preparing and / or inspecting machinery, tools, equipment and supplies, observing the competition, driving to and from the bank to make deposits on behalf on the employer.
Employers are required to pay for travel time to the first appointment or destination of the day if substantial activities are performed from home before traveling to that destination such as obtaining schedules, routing appointments, reading company memos, or preparing tools or supplies for the day. Nonpay for such travel time often affects repairmen and technicians who are dispatched from home.
If you believe you or your co-workers have not fully been paid overtime wages, please call Attorney Joel Bander at (626) 689-2535 to schedule a consultation.
